Selling a let flat

A let flat can be sold at any time. Buyers are usually investors, and the price is based on the rent.

The tenant stays

The tenancy agreement is transferred to the buyer with all rights and obligations (Section 566 of the German Civil Code). Termination on account of the sale is not possible. The deposit is handed over to the buyer.

How the price is determined

Investors calculate the return as follows: annual net rent (rent without service charges) divided by the purchase price. A market-standard rent, a reliable tenant and a well-run owners' association increase the price. If the rent is significantly below market level, the price will be lower than for a vacant flat.

Tenant's right of first refusal

If the flat was only converted into a condominium after the tenant moved in, the tenant has a right of first refusal on the first sale (§ 577 BGB). They can purchase on the same terms within two months of being notified of the purchase contract. We clarify this at the outset.

Viewings and documents

The tenant must permit viewings after reasonable notice. Bundled appointments are more convenient for everyone.

Frequently asked questions

Should I wait until the tenant moves out?

A vacant flat usually achieves a higher price. Until then, however, you forgo no rental income, and a move-out date cannot be planned.

Is tax due on the sale?

For let flats, the profit is exempt from income tax after a holding period of ten years; before that, it is taxable.
